PRIVACY AND COOKIE POLICY – IN COMPLIANCE WITH THE GDPR
Privacy and Cookie Policy for the awenta.pl website
§1. General Provisions
- The Privacy and Cookie Policy for the awenta.pl website (hereinafter: “Policy”) was created and adopted by AWENTA E.W.A. Chomka Spółka Jawna, Stojadła, ul. Warszawska 99, 05-300 Mińsk Mazowiecki, Tax ID (NIP): 822-221-47-11, National Business Registry Number (REGON): 140808498, National Court Register Number (KRS): 0000269756.
- The terms used in this Policy are defined as follows
- WEBSITE: the awenta.pl website;
- USER: any entity using the publicly accessible Website;
- OWNER: AWENTA E.W.A. Chomka General Partnership, Stojadła, ul. Warszawska 99, 05-300 Mińsk Mazowiecki, Tax ID (NIP): 822-221-47-11, National Business Registry Number (REGON): 140808498, National Court Register Number (KRS): 0000269756;
- COOKIES: text files sent by the Website and stored on the User’s end device, which the User uses while browsing websites. The files contain information necessary for the proper functioning of the Website. Cookies most often contain the domain name of the website from which they originate, their storage duration on the end device, and a number.
- The purpose of the Privacy Policy is, in particular:
- to provide Users with information regarding the use of Cookies on the Website, as required by law, including the Telecommunications Law;
- to ensure Users’ privacy protection to the extent consistent with the standards and requirements set forth in applicable legal regulations.
- The Owner limits the collection and use of information regarding Users to the minimum necessary to provide services to them.
- In order to obtain full access through the Website to the content and services offered by the Owner, it is advisable to accept the terms of this Privacy Policy.
- The following legal provisions, among others, apply:
- the Act of July 16, 2004, Telecommunications Law (Journal of Laws 2017.1907, consolidated text, as amended);
- the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws 2017.1219, consolidated text, as amended);
- Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119 of May 4, 2016) together with Polish regulations on the protection of personal data.
§2. Protection of Privacy and Personal Data
- Data concerning Users is processed by the Owner in accordance with the law. Personal data of Users obtained by the Owner is processed on the basis of consent granted by the User or the existence of another legal basis authorizing data processing under the law, in particular the Regulation.
- The Owner exercises due diligence to protect the interests of data subjects and, in particular, ensures that such data is:
- processed lawfully, fairly, and in a transparent manner with respect to Customers and other data subjects;
- collected for specific, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes;
- adequate, relevant, and limited to what is necessary for the purposes for which they are processed;
- accurate and, where necessary, kept up to date;
- stored in a form that permits identification of the data subject for no longer than is necessary for the purposes for which the data are processed;
- processed in a manner that ensures appropriate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.
- The Owner implements appropriate technical and organizational measures to ensure the protection of the personal data being processed, commensurate with the nature, scope, context, and purposes of the processing, as well as the risk of infringement of the rights or freedoms of natural persons.
- The Owner strives to systematically modernize the IT, technical, and organizational measures used to protect this data; in particular, the Owner ensures updates to IT security measures to protect against viruses, unauthorized access, and other threats arising from the operation of the IT system and telecommunications networks.
- The Owner ensures access to data and the exercise of other rights to data subjects—including any User who has provided their data to the Owner in any manner—in accordance with applicable laws, and such individuals are entitled to:
- the right to withdraw consent regarding the processing of personal data;
- the right to information regarding their personal data;
- the right to control the processing of data, including the right to supplement, update, correct, or delete it;
- the right to object to processing or to restrict processing;
- the right to lodge a complaint with a supervisory authority and to seek other legal remedies to protect your rights.
- The Owner may process personal data in an automated manner, including through profiling, in accordance with the principles set forth in the Regulation. In such cases, the Owner’s activities are aimed at marketing purposes or the need to personalize communications sent to Users (including tailoring information to the User’s needs or expectations). The User has the right to object to such processing of their data—this objection may be expressed by sending a message to the Owner’s address: info@awenta.pl
- A person with access to personal data processes it solely on the basis of the Owner’s authorization or a personal data processing agreement and exclusively at the Owner’s instruction.
§3. Cookies
- ookies identify the User, allowing the content of the website they are using to be tailored to their needs. By remembering their preferences, they enable the appropriate tailoring of content directed at them, including advertisements. The Owner uses Cookies to ensure an appropriate standard of convenience for the Website, and the collected data is used solely within the company to optimize operations.
- Cookies are used for the following purposes:
- to tailor the Website’s content to the User’s preferences;
- to optimize the use of the Website, in particular by recognizing the User’s device;
- to generate statistics;
- to maintain the User’s session;
- to deliver advertising content to the User.
- Cookies may be stored on the Website User’s device.

- Completely disabling the option to accept cookies will not prevent you from viewing content posted on the Website, with the exception of content that requires logging in to access.
- Failure to change the settings means that data will be stored on the User’s device (using the Website will result in cookies being automatically stored on the User’s device).
- The stored data placed on the User’s end device does not cause any configuration changes to the User’s end device or the software installed on that device.
- Information regarding cookies also applies to other similar technologies used within the Website.
§4. Final Provisions
- This Policy was adopted by order of the Owner and enters into force on May 23, 2018. Any amendments to the Policy may be made in the same manner.
- Any deviations from this Policy must be made in writing to be valid.
- The law of the Republic of Poland shall govern this Policy.
- In matters not covered by this Policy, the relevant provisions of law shall apply.
